Learning More About Restraints and Nursing Home Abuse

Do you know enough about restraints in nursing homes and the importance of restraint-free care? According to a fact sheet from the California Advocates for Nursing Home Reform (CANHR), we as a society used to believe that the use of restraints was acceptable in nursing homes for elderly adults and those with disabilities. Yet the use of restraints in nursing homes is very dangerous, and it may rise to the level of nursing home abuse. As the fact sheet highlights, restraints “often entail more risks than benefits,” and recent studies “recommend more dignified methods to improve residents’ safety.”

Yet, as the CANHR fact sheet illumines, many nursing homes and assisted-living facilities continue to use unnecessary restraints, putting patients at risk of physical harm. And on the whole, California nursing homes, in particular, may be particularly heavy-handed in their use of unnecessary restraints. The fact sheet notes that “California nursing homes use physical restraints at a rate about fifty percent higher than the rest of the nation.” What else do you need to know about restraints and helping your loved one to obtain restraint-free care in a skilled nursing facility in San Diego?

Nursing Home Abuse and Mental Illness

What do you know about mental health and nursing home neglect?

According to an article in Psychology Today, mental illness has become “the biggest economic burden of any health issue in the world, costing $2.5 trillion in 2010” alone. By 2030, that cost is expected to nearly triple to $6 trillion. However, despite the prevalence and costliness of mental illness—approximately 450 million people across the world currently suffer from some form of mental illness—the article emphasizes that mental health conditions continue to carry a stigma that prevents us as a society from talking about them openly and honestly. Unsurprisingly, the continued stigma of mental health or mental illness also makes its way into nursing homes, where patients who suffer from a mental health condition often becomes victims of nursing home abuse or neglect.

Federal Investigation into Social Media and Nursing Home Abuse in San Diego

Over the last several months, states across the country have been contending with incidents of nursing home abuse that involve social media. Now, according to a recent report ABC 10 News San Diego, federal authorities are “stepping in to make sure elderly residents of nursing homes and senior care facilities are not abused on social media.” The investigation, according to an article from NPR, comes after ProPublica released a series of reports that showed nursing home employees taking “demeaning photographs and videos of residents and post[ing] them on social media.”

Nursing Home Evictions and Elder Abuse in California

If you live in a nursing home, do you have the same rights as a tenant who rents a home from a landlord? According to a recent report from NPR, numerous nursing home residents who live the facility for a temporary inpatient hospital visit return to the nursing home only to learn that they have been evicted. As the article makes clear, this pattern results each year in thousands of nursing home residents finding themselves without a place to live, and that often leads to less-than-ideal situations that can involve elder abuse. Currently, federal law protects nursing home residents from these kinds of evictions, but as the article underscores, “those rules are rarely enforced by the states.” As such, California nursing home residents have decided to file claims against the state of California.

Plaintiffs File Claims Over Nursing Home Evictions

According to the NPR report, when nursing home residents cannot return to their rooms at the nursing facility, they are left with very expensive hospital bills and often the inability to receive the specific kind of care provided in a nursing home. For instance, one plaintiff who was evicted from his nursing home is currently living in his hospital room at Sutter Medical Center in Sacramento. At the end of May 2015, his nursing home sent him to the hospital to receive treatment for pneumonia. However, once the pneumonia had been treated, the nursing home would not readmit him. As such, he has been living at the hospital for about 260 days now. The financial costs are very high: Medicaid is paying “about 2.5 times what his nursing home cost.”

Can Nursing Home Cameras Actually Prevent Abuse?

California and a number of other states have passed laws that permit nursing homes to install cameras and other electronic recording equipment in the private rooms of patients in order to contend with nursing home abuse allegations. These cameras are not intended to invade a resident’s privacy, but rather will only be installed upon the request of a resident. Many elder advocates have praised these laws, suggesting that nursing home staff members will be less likely to engage in acts of abuse if they know they will be recorded on camera. However, according to a recent article in the Pacific Standard, such laws may not be getting at the root of the problem. And as such, laws allowing cameras in nursing homes might not be doing enough to combat the issues at the heart of nursing home abuse and neglect cases.

Recordings to Substantiate Claims of Elder Abuse

According to the article, installing cameras in residents’ rooms at nursing homes intervenes in the issue of elder abuse a bit too late in the process. Rather than exploring the reasons that people engage in acts of nursing home abuse, the cameras (and the footage they record) aim to substantiate claims of abuse when they happen. Or, at best, they might discourage an employee from abusing a particular resident who has a camera installed in his or her room.

Physicians’ Roles in Protecting Elders from Abuse

In a recent article in Emergency Medicine News, one emergency physician in Southern California discusses the limitations of identifying elder abuse and the growing connection between medical malpractice and elder abuse claims.

Difficulty in Obtaining Accurate Patient Histories

Over the last decade, physicians have seen more and more older patients. Given that the number of Americans who are aged 85 and older is growing—and will continue to increase rapidly over the coming decades—more emergency room physicians are seeing elders. But the physician in the article warns that emergency medicine specialists need to be careful to avoid taking shortcuts when it comes to treating elderly patients. While healthcare providers in emergency departments are encouraged to work efficiently, or “faster,” as the author intimates, we need to slow down when seniors come in with injuries that could have been caused from nursing home abuse.

According to a recent article in The Washington Post, “posting abusive photos of the elderly on social media” has become an alarming trend in nursing home abuse cases. While most of us would like to believe that technology can only help seniors to have better lives, whether they are living independently or under the care of nursing home staff, the article should put Californians on alert to the emotional and psychological abuse that is happening at nursing homes across the country.

Dehumanizing Photos of Seniors and Emotional Abuse

As the article notes, advocates who work tirelessly to prevent nursing home abuse have identified a disturbing trend when it comes to elder abuse and social media: “nursing home workers across the country are posting embarrassing and dehumanizing photos of elderly residents on social media networks such a Snapchat, violating their privacy, dignity, and sometimes, the law.” Although many of these incidents are only now coming to light, the article intimates that numerous violations of patient privacy—that we know of—occurred back as far as 2012.
